This document (as well as other documents mentioned herein) regulates the conditions governing the use of this Website (https://transfer2bilbao.com/) and the purchase or acquisition of products and/or services therein (hereinafter, Conditions).
For the purposes of these Conditions, it is understood that the activity carried out by Transfer2bilbao through the Website includes:
Passenger transport service
In addition to reading these Terms and Conditions, before accessing, browsing and/or using this website, the User must have read the Legal Notice and the General Terms and Conditions of Use, including the cookie policy and the privacy policy and the privacy and data protection policy of Transfer2bilbao. By using this Website or by purchasing and/or requesting the purchase of a product and/or service through it, the User agrees to be bound by these Terms and Conditions and by all of the above. Therefore, if you do not agree with all of the above, you should not use this Website.
Please note that these Terms and Conditions are subject to change. The User is responsible for consulting them each time they access, browse and/or use the Website, as those that are in force at the time of requesting the purchase of products and/or services will be applicable.
For any questions the User may have in relation to the Terms and Conditions, they may contact the owner using the contact details provided above or, where appropriate, using the contact form.
Description of passenger transport services
- Booking a transport service with us means that a driver will be the person who meets and welcomes you to your city and/or transfers you during your stay.
- In particular, the transport services that you can book through the Website are as follows (hereinafter referred to as ‘Transport Services’ or ‘Pick-ups’ or ‘Transfers’):
- Transport of passengers to and from airports, ports, train stations, bus stations.
- Transport of passengers to and from their place of residence.
- Transportation of passengers to and from places of interest.
- Transportation of passengers to and from a point of interest in the city, including stops (for food, activities, photos, etc.).
- Transportation of passengers during the tour and transportation to and from places of activity based on your interests.
- To make your pick-ups a personal experience for you, we will send you the name of the driver and their taxi licence number if this has been provided to us.
We are not a licensed private hire operator or a transport provider and do NOT provide transport services. We act solely as an intermediary between you and the driver. By booking your collection through the Website, you enter into a direct and legally binding contractual relationship with the driver who accepts your collection. The Company provides information and a method to facilitate Transport Services, therefore it has no responsibility for any Transport Services provided by Drivers.
Legal status of the company
- Our company provides electronic or telephone mediation services for passenger transport. As an electronic mediator in the Transport Service provided by Drivers, we act solely as intermediaries between Passengers and Drivers. Through its website, the Company provides mediation services for the provision of Transport Services by Drivers to Passengers. In reality, the Company does not itself provide, nor could it be considered to provide, Transport Services. If you make a reservation for a Transport Service through the Website, you acknowledge that you are entering into a contract for the provision of the Transport Service solely with the Drivers, and you and the Driver are solely responsible for the fulfilment of the Transport provision.
- The Company does not provide transport services and is not involved in the relationship between you and the driver who picks you up, as the contractual relationship for the provision of transport services is established exclusively between you and the driver who agrees to provide you with transport services. The Company does not participate as a contracting party in these contracts in any way, nor does it obtain any rights or obligations arising from such contracts. The Company assumes no responsibility for the transportation of Passengers, for which Drivers are solely responsible. As a result, the Company, its representatives, employees, and assistants are not liable in any way for the risks associated with the conclusion, execution, and completion of transactions between Passengers and Drivers and are not liable in any way for any damages arising from such transactions. Furthermore, the choice to book a pick-up through the Website is at your sole discretion. However, if you accept, you are bound by and warrant that you will comply with all obligations arising from these Terms of Use.
- The Company does not represent you or the Driver, and therefore makes no warranty regarding the quality of the Transport Services, the completion of the Transfer, or the behaviour of Passengers and Drivers. Furthermore, the Company does not represent or act on behalf of any transport company.
- Please note that drivers do not have an employment relationship with the Company or its partners. The Website is a method of connecting you with Drivers. Furthermore, the Company does not provide any insurance for drivers or their vehicles and accepts no responsibility if you lose your belongings while in a car.
- The Company may refer you to Drivers for the provision of Transport Services. It will not assess the suitability, legality or capacity of any Driver, and you expressly waive and release the Company from any and all claims, liabilities or damages arising from or in any way related to the Driver. The Company shall not be a party to any dispute between you and the Drivers. By booking the Transport Services, you acknowledge that the Company has no involvement in the contractual relationship between the Driver and you; however, the Transport Services are governed by these General Terms.
- The intermediary services we provide are only available for personal, non-commercial use. Therefore, you are not permitted to resell, distribute via deep links, use, copy, crawl (e.g. via spider, scraping), display, download or reproduce any content or information, software, products or services available on the Website for any commercial or competitive activity or purpose.
2. THE USER
Accesing, browsing and using the Website confers the status of user (hereinafter referred to, interchangeably, individually as User or collectively as Users), and therefore, from the moment you start browsing the Website, you accept all the Conditions set out herein, as well as any subsequent modifications, without prejudice to the application of the corresponding mandatory legal regulations, as the case may be.
The User assumes responsibility for the correct use of the Website. This responsibility shall extend to:
- Use this Website solely to make legally valid enquiries and purchases or acquisitions.
- Do not make any false or fraudulent purchases. If it could reasonably be considered that such a purchase has been made, it may be cancelled and the relevant authorities will be informed.
- Provide accurate and lawful contact details, such as email address, postal address and/or other details (see Legal Notice and General Terms and Conditions of Use).
The User declares that they are over 18 years of age and have the legal capacity to enter into contracts through this Website.
The User may, at their discretion, enter into a contract with Transfer2bilbao for the sale of the desired products and/or services in any of the languages in which these Terms and Conditions are available on this Website.
User cancellation request policy
You have the right to cancel a transfer already booked through us at any time by contacting the Company, either via WhatsApp at the telephone number provided in the confirmation email or on the website, or by emailing info@transfer2bilbao.com.
If we receive a cancellation request up to 24 hours before the scheduled pick-up time, you will not incur any penalty and will be refunded for the service.
If the Company receives a cancellation request within 24 hours prior to the scheduled pick-up time, it is considered a last-minute cancellation and is non-refundable, resulting in a 100% cancellation fee and NO refund to the Traveller.
Passenger change request policy
You may contact the Company via WhatsApp at the telephone number provided in the confirmation email or on the website or email info@transfer2bilbao.com and request to change any of the booking details up to 24 hours before the scheduled pick-up time.
Depending on the changes requested, the transfer price may change. On that occasion, you will be informed of the new transfer price, and the new transfer details will be effective once there is confirmation of payment of the new transfer price, where applicable. If the new transfer price is lower, the Company will partially refund you. If the new transfer price is higher, you will be required to pay the additional amount (if any) due to the change request.
The Company cannot accommodate any changes to the details of requested Transfers less than 24 hours before the scheduled pick-up time. On this occasion, the transfer will be operated as originally booked, or you may proceed with a cancellation request, subject to the user’s cancellation request policy.
Complimentary waiting time policy
Your Driver will be waiting for you at the Pick-up location at the time scheduled in the Booking Order, subject to the provisions of this Complimentary Waiting Time Policy and Extra Waiting Time Policy, so you must ensure you arrive on time to avoid being marked as a no-show, in which case all the Terms of the Traveller No-Show Policy will apply.
The Company offers the following complimentary waiting times, depending on the type of transfer booked:
- Airport: 60 minutes
- Port, railway station, bus station: 20 minutes
- Other pick-ups (including sightseeing tours): 15 minutes
The free waiting time starts from the scheduled pick-up time.
More specifically, for an airport/port pick-up where the scheduled pick-up time is different from the flight/ship arrival time and the flight/ship is delayed and expected to be later than the scheduled pick-up time, the new arrival time becomes the pick-up time.
For airport/port pick-ups where the scheduled pick-up time is the flight/cruise arrival time and there is a delay to the flight/cruise, the free waiting time commences from the time the flight/cruise arrives, provided the traveller has supplied the correct and adequate flight/cruise details to enable the arrival to be tracked. The above applies to delays of up to 2 hours. If the flight/cruise is delayed by more than 2 hours, the transfer will be cancelled and the trip will be considered complete, with no refund available.
For airport/port pick-ups where the pick-up time is the flight/cruise arrival time and the flight/cruise arrives earlier than scheduled, the pick-up time will be the actual arrival time, which may be brought forward if the driver is available.
For airport pickups where travelers arrive on more than one flight, the Company considers the scheduled pickup time to be the time declared by the Traveler as the arrival time during the booking, or an updated arrival time in accordance with the Traveler Change Request Policy. Any note left by the Traveler during the booking mentioning multiple flights does not constitute an adjustment to the scheduled pickup time. In the event that a group of travelers arriving on multiple flights landing at different times have booked a transfer, it is suggested that they add the flight details (the last flight to arrive).
Additional waiting time policy
Additional waiting time is defined as an amount of time beyond the complimentary waiting time offered by the Company for which the Traveler asks the Driver to wait.
You may request that the Driver wait for you longer than the Company’s complimentary wait time under the Complimentary Wait Time Policy, either in advance (before the Transfer is operated) or no later than the end of the complimentary wait time. You can do this by contacting the Company’s Customer Service, either via WhatsApp at the phone number provided in the confirmation email or on the website, or by sending an email to info@transfer2bilbao.com .
The Company can only guarantee additional waiting time as additional waiting time for the Traveler if the additional waiting time has not been requested at least 12 hours prior to the scheduled pickup time.
If you request additional waiting time and the assigned driver is able to accommodate it, you will be charged an additional fee for each 15 minutes of additional waiting time, as follows:
- Sedan: EUR 10.00 / 15 min
- Minivan: EUR 20.00 / 15 min
The Company does not charge any additional commission on top of these fees.
When the request for additional waiting time can be accommodated by the Driver, you must give your consent to the applicable additional fees, either via WhatsApp with the Company or directly with the driver. Payment of the fee must be made directly to the driver before the start of the transfer, or electronically to the company.
No-Show Policy
A No-Show Traveler (NST) is defined as a Traveler who is not at the pickup location at the end of the additional waiting time, or the additional waiting time if agreed upon between the Traveler, the assigned Driver, and the Company in accordance with the Complementary Waiting Time Policy and the Extra Waiting Time Policy.
The pick-up location is defined as the location where the Traveler has requested to be picked up. In the case of airport/port pick-ups, the Company will notify you via the booking confirmation email of the exact pick-up location where the driver will be waiting for you (i.e., arrivals hall, departures hall, etc.).
On occasions when the Traveler does not show up at the pick-up location at the end of their complimentary waiting time, or at the end of the additional waiting time, or if the Driver has been unable to accommodate a request for “Additional Waiting Time,” the Transfer is marked as a “No Show by Traveler” (“VNS”). In this case, no amount is refunded to the Traveler.
If you are not at the pick-up location at the scheduled pick-up time, and the pick-up location is an airport, port, train station, or bus station, the assigned driver will attempt to contact you by text message/WhatsApp or will attempt to call you on your mobile phone. By booking a transfer, you agree that we may provide your mobile phone number to your driver.
A potential VNS will be reported by the driver to the Company at the following times:
- For airport pickups, within 50 minutes of a passenger’s delay in arriving at the pickup location after the scheduled pickup time.
- For pickups at the port, train station, and bus station within 10 minutes of a traveler’s delay in arriving at the pickup location after the scheduled pickup time.
- For sightseeing tours and other transportation services within 5 minutes of a traveler’s delay in arriving at the pickup location after the scheduled pickup time.
Upon notification from a driver of a potential VNS, the Company will attempt to contact you (by phone call and/or text message/WhatsApp and/or email) in an effort to locate you. These efforts will be made until the end of your free waiting time in accordance with these Terms of Use.
At the end of your free waiting time, the following will happen:
- If you have not been contacted (you have not responded), we must “release” the driver. On this occasion, the transfer is marked as “VNS.”
- If you have been contacted and informed that you will be at the pick-up location at the end of the free waiting time, we must inform the driver to wait. If you do not show up at the end of the free waiting time, we will make a final attempt to contact you and, depending on the outcome, we will either release the driver immediately or follow the Company’s additional waiting time policy accordingly. You will be charged for the wait before resuming the trip. Otherwise, it may be terminated.
- If you have been contacted and have requested additional waiting time, we will contact the driver, while the additional waiting time policy will apply accordingly.
You have 24 hours to dispute a VNS by contacting Transfer2Bilbao customer service. When you dispute a VNS, if the driver was at the pick-up location between the scheduled pick-up time and the end of the complimentary waiting time (or additional waiting time, if applicable), there is sufficient evidence to assume that the driver was at the pick-up location according to Company policy. If there is sufficient evidence to assume that both you and the driver were at the pick-up location but did not meet and the transfer did not take place, you will be refunded 50% of the transfer price, while 50% will be retained by us to partially cover the driver’s fare, as the Company is responsible for paying their fare.
Driver no-show policy
The driver must be at the pick-up location at the scheduled pick-up time. If the driver is going to be up to 10 minutes late, they will contact and notify the passenger (by phone call and text message/WhatsApp) as far in advance as possible, and no later than the scheduled pick-up time.
If the driver is more than 10 minutes late, they will contact and notify the Company’s CS as soon as possible, and no later than the scheduled pick-up time. The Company’s CS will contact the traveler and notify them of the driver’s expected delay.
Baggage allowance policy
When booking your transfer, you will be asked to declare the number of pieces of baggage you will be carrying with you during the transfer. One piece of baggage is considered to be a medium to large backpack.
Should you be carrying additional items such as baby strollers, pet carriers, sports equipment, folding wheelchairs, musical instruments, etc.? You must declare one piece of luggage for each of these items and add a note to the reservation describing them. The Company may contact you for clarification and adjust the reservation details accordingly to ensure that the appropriate type of car is assigned to operate the transfer.
The price of the transfer and the type of car assigned to operate the booked transfer are calculated based on factors including the number of passengers and pieces of luggage declared. If you arrive with more passengers and/or more pieces of luggage than declared, and the assigned driver cannot accommodate them safely and legally, the driver will contact the Company before the start of the Transfer to explain the situation and help you arrange another taxi if you wish. In this case, the driver will only carry the number of passengers and pieces of luggage declared in the transfer reservation.
If you arrive with more passengers and/or luggage than declared, and the assigned driver can accommodate them safely and legally, the driver must contact the Company before the start of the transfer to explain the situation. If the additional number of passengers and/or luggage combination results in a different transfer price, the Company will recalculate it and notify you accordingly. If you agree to pay the additional charges, the driver will accommodate the additional passengers and/or pieces of luggage. Otherwise, the driver will kindly assist you in obtaining another taxi and will transport the number of passengers and pieces of luggage declared in the transfer reservation.
The Company will not bear the cost of any other means of transportation used by you.
3. PURCHASE OR ACQUISITION PROCESS
Duly registered Users may purchase on the Website by the means and methods established. They must follow the online purchase and/or acquisition procedure at https://transfer2bilbao.com/, during which various products and/or services may be selected and added to the cart, basket, or final purchase space and, finally, click on: “Pay.”
Likewise, the User must fill in and/or check the information requested at each step, although during the purchase process, before making the payment, the purchase details can be modified.
The User will then receive an email confirming that Transfer2bilbao has received their order or request for purchase and/or provision of the service, i.e., the order confirmation. And, where applicable, they will also be informed by email when their purchase is being shipped.
Once the purchase process is complete, the User agrees that the Website will generate an electronic invoice that will be sent to the User via email. Likewise, the User may, if they wish, obtain a paper copy of their invoice by requesting it from Transfer2bilbao using the contact details on the Website or via the contact details provided above.
The User acknowledges that, at the time of purchase, they are aware of certain specific conditions of sale relating to the product and/or service in question, which are displayed alongside the presentation or, where applicable, image of the product or service on the Website page, indicating, by way of example, but not limited to, and depending on each case: name, price, components, weight, quantity, color, product details, or characteristics, how they will be carried out and/or the cost of the services; and acknowledges that placing the purchase order or acquisition constitutes full and complete acceptance of the specific conditions of sale applicable to each case.
Communications, purchase orders, and payments involved in transactions carried out on the Website may be archived and stored in Transfer2bilbao’s computerized records in order to constitute proof of the transactions, in all cases complying with reasonable security conditions and the applicable laws and regulations in force in this regard, and particularly in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights, and the rights of Users in accordance with the privacy policy of this Website.
4. AVAILABILITY
All purchase orders received by Transfer2bilbao through the Website are subject to product availability and/or to no circumstances or causes of force majeure (clause nine of these Terms and Conditions) affecting the supply of the same and/or the provision of services. If there are difficulties in supplying products or there are no products left in stock, Transfer2bilbao undertakes to contact the User and refund any amount that may have been paid. This shall also apply in cases where the provision of a service becomes impossible.
5. PRICES AND PAYMENT
The prices displayed on the Website are final, in Euros (€) and include taxes, unless otherwise indicated and applied due to legal requirements, particularly with regard to VAT.
However, unless otherwise indicated, the prices of the items offered do not include any shipping costs that may be incurred, which will be added to the total amount due at the time the User processes the shipping procedure, where the User will consult the available shipping methods and costs and freely choose the one that best suits them.
Under no circumstances will the Website automatically add additional costs to the price of a product or service, but only those that the User has voluntarily and freely selected and chosen.
Prices may change at any time, but any changes will not affect orders or purchases for which the User has already received an order confirmation.
The following payment methods are accepted: Credit or debit card, and PayPal.
Transfer2bilbao uses all means to ensure the confidentiality and security of payment data transmitted by the User during transactions through the Website. As such, the Website uses a secure SSL (Secure Socket Layer) payment system.
Credit cards will be subject to checks and authorizations by the issuing bank. If the bank does not authorize the payment, Transfer2bilbao will not be responsible for any delay or non-delivery and will not be able to formalize any contract with the User.
Once Transfer2bilbao receives the purchase order from the User through the Website, a pre-authorization will be made on the corresponding card to ensure that there are sufficient funds to complete the transaction. The card will be charged when the User receives confirmation of shipment and/or confirmation of the service provided in the manner and, where applicable, at the locations established.
If the payment method is PayPal, the charge will be made when Transfer2bilbao sends a confirmation of the purchase order or acquisition of products and/or services to the User.
In any case, by clicking on “Pay,” the User confirms that the payment method used is theirs.
6. TECHNICAL MEANS FOR CORRECTING ERRORS
Users are informed that if they detect an error when entering the data necessary to process their purchase request on the Website, they may modify it by contacting Transfer2bilbao through the contact spaces provided on the Website, and, where appropriate, through those provided for contacting customer service, and/or using the contact details provided in clause one (General Information). Likewise, this information may also be corrected by the User through their personal space on the Website.
In any case, before clicking on “Pay,” the User has access to the space, cart, or basket where their purchase requests are recorded and can make modifications.
Similarly, Users are referred to the Legal Notice and General Conditions of Use and, specifically, the Privacy Policy for further information on how to exercise their right of rectification in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights.
7. RETURNS
In cases where the User purchases products on or through the Owner’s Website, they are entitled to a series of rights, as listed and described below:
Right of withdrawal
To exercise this right of withdrawal, the User must notify Transfer2bilbao of their decision. They may do so, where applicable, through the contact spaces provided on the Website.
Regardless of the means chosen to communicate their decision, Users must clearly and unequivocally state that it is their intention to withdraw from the purchase contract. In any case, Users may use the withdrawal form template provided by Transfer2bilbao as an annex to these Terms and Conditions, although its use is not mandatory.
To meet the withdrawal deadline, it is sufficient for the communication expressing the unequivocal decision to withdraw to be sent before the expiry of the corresponding period.
- If the reserved transfer is canceled by the company for operational capacity reasons.
- If the reserved transfer is canceled due to an incident of force majeure (strike, demonstration, natural disaster, accident, etc.).
Other cases:
- If we receive a cancellation request more than 48 hours before the scheduled pick-up time, there is no penalty and you will be refunded for the service.
- If the cancellation is made within 24 to 48 hours, there is a penalty of 50% of the amount of the service.
- If the Company receives a cancellation request within 24 hours prior to the scheduled pick-up time, it is considered a last-minute cancellation and is non-refundable, resulting in a 100% cancellation fee and NO refund to the Traveler.
- In the event of a “No-Show” disputed by the Traveler, if there is sufficient evidence to assume that both the Traveler and the driver were at the pick-up location but did not meet and the transfer did not take place, the Traveler will be refunded 50% of the transfer price according to the Traveler’s no-show policy.
- Transfer2bilbao will refund the User using the same payment method used by the User to make the initial purchase transaction. This refund will not incur any additional costs to the User.
The provision of any service that the User may contract on this Website is governed in the same way, as this same Law establishes that Users will not have the right of withdrawal when the service has been fully performed, or when it has begun, with the express consent of the consumer and user and with their acknowledgment that they are aware that, once the contract has been fully performed by Transfer2bilbao, they will have lost their right of withdrawal.

8. DISCLAIMER OF LIABILITY
Unless otherwise required by law, Transfer2bilbao shall not accept any liability for the following losses, regardless of their origin:
- any losses that were not attributable to any breach on its part;
- business losses (including loss of profits, income, contracts, anticipated savings, data, goodwill, or unnecessary expenses incurred); or
- any other indirect loss that was not reasonably foreseeable by both parties at the time the contract for the sale of services between both parties was formalized.
Similarly, Transfer2bilbao also limits its liability in the following cases:
- Transfer2bilbao takes all measures to provide an accurate representation of the product on the Website. However, it is not responsible for any minor differences or inaccuracies that may exist due to screen resolution, browser issues, or other similar problems.
- Transfer2bilbao will act with the utmost diligence to make the product ordered available to the company responsible for its transport. However, it is not responsible for damages resulting from transport malfunctions, especially due to causes such as strikes, roadblocks, and in general any other causes specific to the sector, which result in delays, losses, or theft of the product.
- Technical failures that, due to unforeseen circumstances or other causes, prevent the normal functioning of the service via the internet. Lack of availability of the Website due to maintenance or other reasons that prevent the service from being available. Transfer2bilbao makes every effort to carry out the purchase, payment, and shipping/delivery of the products; however, it is not liable for causes beyond its control, unforeseeable circumstances, or force majeure.
- In general, Transfer2bilbao shall not be liable for any failure or delay in the fulfillment of any of the obligations assumed, when this is due to events beyond its reasonable control, that is, due to force majeure, which may include, but is not limited to:
- Strikes, lockouts, or other industrial action.
- Civil commotion, riot, invasion, terrorist threat or attack, war (whether declared or not) or threat or preparation for war.
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster.
- Inability to use trains, ships, planes, motor transport, or other means of transport, whether public or private.
- Inability to use public or private telecommunications systems.
- Acts, decrees, legislation, regulations, or restrictions of any government or authority.
In this way, obligations will be suspended for the duration of the force majeure event, and Transfer2bilbao will be granted an extension to fulfill them for a period equal to the duration of the force majeure event. Transfer2bilbao will use all reasonable means to find a solution that allows it to fulfill its obligations despite the force majeure event.
9. WRITTEN COMMUNICATIONS AND NOTIFICATIONS
By using this Website, the User agrees that most communications with Transfer2bilbao will be electronic (email or notices posted on the Website).
For contractual purposes, the User agrees to use this electronic means of communication and acknowledges that all contracts, notifications, information, and other communications that Transfer2bilbao sends electronically comply with the legal requirements of being in writing. This condition shall not affect the rights recognized by law to the User.
The User may send notifications and/or communicate with Transfer2bilbao using the contact details provided in these Terms and Conditions and, where applicable, through the contact spaces on the Website.
Similarly, unless otherwise stipulated, Transfer2bilbao may contact and/or notify the User at their email address or postal address provided.
10. WAIVER
No waiver by Transfer2bilbao of any specific right or legal action, or failure by Transfer2bilbao to require strict compliance by the User with any of their obligations, shall constitute a waiver of other rights or actions arising from a contract or the Terms and Conditions, nor shall it exempt the User from compliance with their obligations.
No waiver by Transfer2bilbao of any of these Terms and Conditions or of the rights or actions arising from a contract shall be effective unless it is expressly stated to be a waiver and is formalized and communicated to the User in writing.
11. NULLITY
If any of these Conditions are declared null and void by a final decision issued by a competent authority, the remaining clauses shall remain in force and shall not be affected by said declaration of nullity.
